The timing of a request for an emergency hearing filed by Samsung in regards to the patent litigation between them and rival Apple in Australia had nothing to do with the “New iPad”. Many tech websites caught this story on Thursday and presumed, (rightfully so) that when Samsung filed a motion for an emergency hearing on Thursday morning it was in regards to the iPad that had been launched less than 24 hours early.
ITNews in Australia was in the Federal Court Friday morning and found out that the emergency hearing for an interlocutory application was unrelated to the new iPad. At the same time, ITNews was able to get Samsung to admit they aren’t ruling out potential future action against the new iPad.
The interlocutory application called for Apple to set aside recently submitted evidence in it’s case against the Samsung Galaxy Tab 10.1.
