Apple Wins Injunction Stopping Galaxy Tab Sales In Europe


We’ve just heard via the Silicon Alley Insider through German news agency dpa that Apple has been granted a preliminary injunction against Samsung temporarily blocking the sales of the Samsung Galaxy Tab 10.1 in other parts of the European Union except for the Netherlands. 

This German injunction comes with some very stiff penalties.  According to SAI sales of the Samsung Galaxy Tab 10.1 in the areas where the injunction stands, could result in fines of $350,000.00 (US) or imprisonment for Samsung’s management.

German patent law is a lot stricter than the United States.  In the US patent violators need to fail a four factor test to qualify for an injunction.  In Germany, patent holders always win an injunction.

Apple and Samsung are in patent legal disputes all over the world stemming from the Samsung Galaxy S series phones and Samsung Galaxy Tab series of Android tablets.

  1. So early launches of tab 10.1 for Asian countries where it hasn’t launched yet?! Since they have so much stock allocated for europe that will not be able to be sold?! lolz… come come… come to Malaysia!
